The Further and Higher Education (Governance and Information) (Wales) Act 2014 (Commencement) Order 2014

EXPLANATORY NOTE

(This note is not part of the Order)

This is the only commencement order made under the Further and Higher Education (Governance and Information) (Wales) Act 2014 (“the Act”).

Article 2 brings into force section 3 of the Act on the 1 August 2014 for the purpose of making regulations.

Article 3 brings all the remaining provisions of the Act into force on the 1 September 2014, except those provisions of the Act which commenced on Royal Assent in accordance with section 11 of the Act.

Made                                             1 July 2014

The Welsh Ministers, in exercise of the powers conferred by section 11(2) and (3) of the Further and Higher Education (Governance and Information) (Wales) Act 2014([1]) make the following Order.

Title and interpretation

1.(1)(1) The title of this Order is the Further and Higher Education (Governance and Information) (Wales) Act 2014 (Commencement) Order 2014.

(2) In this Order “the Act” means the Further and Higher Education (Governance and Information) (Wales) Act 2014.

Provisions coming into force on 1 August 2014

2. The appointed day for section 3 of the Act coming into force for the purpose of making regulations is 1 August 2014.

Provisions coming into force on 1 September 2014

3. The appointed day for the coming into force of the following provisions of the Act is 1 September 2014—

(a)     section 1 (borrowing and investing by further education corporations);

(b)     section 2 (instrument and articles of government of further education corporations);

(c)     section 3 (dissolution of further education corporations) in so far as not commenced by article 2;

(d)     section 4 (designated institutions: instrument and articles of government);

(e)     section 5 (intervention by Welsh Ministers in respect of institutions within further education sector);

(f)      section 6 (abolition of duties of further education institutions to comply with directions);

(g)     section 7 (abolition of power to regulate higher education courses in further education sector);

(h)     section 8 (minor and consequential amendments);

(i)      section 10 (review of operation of Act).
